Introduction
The Weis Group of Companies (herein referred to as “Weis”) is committed to protecting the privacy rights of its clients and employees, as well as others with
whom it deals with. You may provide Weis with personal information, gathered through this website. It is the desire of Weis to ensure that the use of all personal
information respects your privacy rights and the legal obligations of Weis.
The purpose of this Privacy Policy is to detail Weis’s standards in dealing with information, and is developed and adopted pursuant to the applicable privacy legislation.
To the extent that there is any conflict with this Privacy Policy and the applicable privacy legislation, the legislation governs.
Weis may revise this Privacy Policy at any time, within its sole discretion, and without any notice. You are responsible for visiting this Privacy Policy in order
to determine if any changes have been made.
Weis retains the right to use aggregated information in any way that it reasonably determines is appropriate.
Definitions
For the purposes of this Privacy Policy:
- The terms “you” and “your” applies to each and every individual who may access and use this website and may provide personal information, or for whom personal
information may be collected.
- The term “personal information” means information which identifies an individual or where it would be reasonably expected that an individual could be identified by
the information, and includes but is not limited to information such as name, address, telephone number, facsimile number, email address, customer number, and information
relating to the individuals’ citizenship, sex, gender identity/expression, age, marital status, family status, and disability, as well as information concerning inquiries
made by you and the provision of services by Weis to you. Personal information may be collected from documents provided by you, marketing and sales/promotions
initiatives, purchases you have made and by other means permitted by you.
Application
This Privacy Policy applies to Weis in regards to the collection, use, storage, and disclosure of personal information that is in the custody and control of
Weis. Weis staff have all been trained in this respect. Personal information is only collected, used and disclosed as permitted by, and in compliance with, applicable
legal or regulatory requirements or provisions. Weis will not use personal information for any other purpose than identified in this Privacy Policy at or before the
time of collection.
Purpose
Weis collects, uses, stores, and discloses personal information in order to provide services, use services, evaluate, conduct research and compile statistics,
and improve services, further to the range of services provided by it to its clients. Weis also produces direct marketing materials and publications concerning its services,
and shares such information with its clients, prospective clients, referral sources and staff. All of this may include the sharing of personal information to and
from third parties for such purposes. Such sharing of information with third parties is only on an “as needed” basis and provided such third parties agree to be bound
by this Privacy Policy. Weis does not disclose personal information to any third party to enable them to market their products and services.
Consent
If you have voluntarily provided personal information to Weis (or its service providers and agents), you have consented to the collection, use and disclosure of personal information
as described in this Privacy Policy and as permitted or required by law, and Weis may rely on the fact that you have all necessary authority and/or have obtained all necessary
consents to enable Weis to collect, use and disclose such personal information. Weis will not use personal information for any purpose other than that for which consent was
received. If Weis seeks to use your personal information for purposes other than those for which your consent has previously been obtained, or requires personal information for
a new purpose, it will obtain the necessary consent from you.
There may be occasions where more specific personal information is necessary for Weis to proceed with a request for information, or provide you with services.
In such cases, Weis will provide you with a description of the information required. In all cases, Weis limits the amount and type of information collected to only the personal
information that is required.
Subject to legal and contractual requirements, you may refuse or withdraw consent to certain of the identified purposes at any time by contacting Weis’s Privacy Officer.
Subject to application legislation, if such consent is withheld or withdrawn, Weis may be unable to provide services to you.
Website Privacy
In general, you can use this website without giving Weis any personal information. If you are one of our anonymous visitors, please bear in mind that we may
still record certain analytical information. Weis may use cookies, web beacons/pixel tags, log files and other technologies to collect certain information about
visitors to this website, and recipients of Weis newsletters, invitations and other communications.
Accuracy and Access of Information
Weis takes efforts to keep personal information collected and used by it as accurate, complete, and up-to-date as is necessary for the purposes for which it is to be
used. Weis will update any changes to personal information when received from you. If Weis holds personal information about you, which can be established by you
to be inaccurate, incomplete or not up-to-date, Weis will take reasonable steps to correct it.
Upon your written request made to Weis’s Privacy Officer, you may view or edit your personal information as collected by Weis. Weis will inform you of the personal
information Weis has about you, what it is being used for and, in cases where it has been disclosed, to whom it has been disclosed. The right of access
to personal information is not absolute, and access may be denied in one or more of the following circumstances:
- Weis is required or authorized by law to do so
- the granting of access would have an unreasonable impact on the privacy of others or prejudice the relationship between Weis and any one or more of its clients
- in order to protect the rights and property of Weis
- in the event that the request is frivolous or vexatious
If access to personal information is denied, Weis shall explain the reason(s) behind such refusal to you, as applicable.
Wherever it is legal and practicable to do so, Weis may be able to deal with general inquiries without disclosing personal information.
To make a request for access to personal information, you can send a letter, email or facsimile addressed to Weis’s Privacy Officer at the address indicated below,
with your name and contact details, as well as the nature of the request. All requests will generally be responded to within 30 calendar days. However, up to 60
calendar days may be required in the case of complex requests or where there is a substantial increase in requests.
Summary information is available on request, subject to the foregoing limits, but more detailed requests requiring archive or other retrieval costs may be
subject to disbursement fees.
Storage
Weis will maintain the personal information as long as is required for its purposes. The retention period may be extended as a result of minimum retention
periods provided in the applicable legislation. Further, the retention period may be extended for other reasons, such as pursuant to a litigation hold.
